 Lewes parking appeal: tribunal beckons

    I have just posted off my appeal letter. I have elected for a tribunal hearing at Brighton court.

    I'd be interested to hear from anyone who has got this far without ESSCC caving in before. I'd also be interested to hear of any tactics that I might take at the hearing. I am not averse to making some sort of statement or the creation adverse publicity or even making some sort of test case.

    Succinctly. I park in Pinwell car park most days. Alway paying and displaying a ticket. On the day in question the ticket slipped beween the dashboard and the windscreen. The attendant did not see it. I could easily see the corner of it and noted it within a second or two of seeing the PCN. The scanned copies of the photos he took are not of sufficient quality to show the ticket, and I'm not certain he has taken one of where the ticket was anyway. I have supplied evidence that I bought a ticket on the day in question.

    I think they should allow any appeal where the driver can show they had a legitimate ticket, tbh. I fail to see how you can be held responsible for something that happens after you've left your car, especially as they have stupid non-sticky tickets.

    I wish I had had the wherewithal to take a photo of the ticket peeping out at the back of the dashboard but it didn't occur to me. I'm not sure how it would have provided much proof anyway. I could take a photo of a slipped ticket any time.

    I suppose their view would be anyone could put an old ticket with the corner sticking out and then get a ticket from someone else that was parking and say it was theirs. If you're not careful you could end up as an 'Absolutely Furious and More Out Of Pocket Lewes Worker'. Fair or not.

    So, if you don't agree with the terms and conditions you can't park in Lewes? Basically you have no choice *but* to agree the terms and conditions. In actuality they are imposed upon you.

    It is not NCP's fault that your ticket was not displayed, yet you are acting like it is anyones fault but your own. I hope you get the costs awarded against you for wasting court time.

    East Sussex County Council (who work for you) should not fine anyone who does their best to follow sensible rules. You CAN blame East Sussex County Council if they try to insist on moneygrubbing from people who have acted in good faith but made a trivial mistake, such as ALW. Remember, they work for you, and you elect the county councillors responsible for the system.
    Have you asked your county councillor what they think about the system, and what they are going to do to get this penalty notice withdrawn for you? They are paid to work for you - call on their services.
